Las Obtenciones Vegetales en Colombia: Un Análisis Crítico Desde sus Implicaciones Sociales y Ambientales

The objective of this article is to raise a criticism of the regulation of plant varieties in Colombia, from the legal interests protected in the current system; food policy; and the need to generate a policy of social and environmentally responsible competitiveness. The methodology is qualitative, from a documentary analysis approach on the information and data obtained in documents from national and international organizations, theory, public policies, jurisprudence, and current regulations. As a result, the authors present some reflections with a view on politics, domestic law, and international law. In addition, they reflect on the new postmodern currents, especially Transhumanism. The article concludes that it is necessary to rethink the regulation of plant varieties. This regulation does not generate profits for farmers and the national industries, in the search for sustained internal growth; on the contrary, it generates some negative impacts on the environment and society.
