La evaluación del impacto de género y la responsabilidad social de género, instrumentos para la consecución de la igualdad efectiva de mujeres y hombres

Abstract

Equality between women and men is one of the key rights of the legal system. It constitutes a great value for democracy and it is an objective that must be integrated into all the policies and actions of the States. International, European and internal legal regulations on gender equality are analyzed in this study, emphasizing on how they have incorporated the principles of equal opportunity, non-discrimination and mainstreaming from a gender perspective. In private law, equality is approached as an emerging value of social corporate responsibility, and provisions on this matter are discussed in Organic Law 3/2007 on the effective equality of women and men, stressing the regulation to achieve a balanced presence of women and men on boards of directors in the Spanish companies. Also, measurement indicators of equality in various areas, which are considered key in business management, are proposed. Moreover, this study analyses the specific functions and characteristics of the methodology of gender impact assessment, which is a process that seeks to translate the equality of women and men in the routine government action. This is pursued through a structured analyses on the impact on women and men as an integral part of the policy making. Also, the elements and indicators for these assessments are identified. Finally, this thesis offers a study on the regulation of gender impact reports and documents intended to be incorporated into the processing file of regulatory provisions, and its differential treatment in the regions of Andalusia and the Basque Country, as well as a detailed assessment of its development and effectiveness in Catalonia
