Constitución, tercera edad y sistema de pensiones en el Perú

Abstract

The research "Constitution, Old Age, and the Pension System in Peru" addresses two key aspects related to older persons. The first section establishes the constitutionality of the fundamental right of older persons to special protection based on a detailed study of the provisions of the Peruvian Constitution, the interpretive criteria derived from the jurisprudence of the Constitutional Court of Peru, international human rights treaties, and the standards issued by the Inter-American Court of Human Rights within the framework of its contentious and advisory function in declaring the international responsibility of States. This first part is complemented, on the one hand, by the presentation of statistics and data from the United Nations and the National Institute of Statistics and Informatics of Peru (INEI) that approximate the phenomenon of global and national aging, respectively, and on the other hand, by the presentation of documents, international plans, letters and non-binding declarations from the United Nations, the Economic Commission for Latin America and the Caribbean (ECLAC) and the Organization of American States (OAS) which allow a deeper approach to this phenomenon. En la segunda parte de la investigación, se configura el parámetro de constitucionalidad del derecho fundamental a la pensión bajo la misma perspectiva. Es decir, como derecho autónomo y como forma de materializar el derecho de las personas adulto mayores a una protección especial. Se complementa con el estudio de la realidad previsional de las personas adultas mayores en el Perú con estadísticas de los beneficiarios de las pensiones y con el desarrollo del actual sistema legal de pensiones del régimen público y privado.
