The birth registration (Act 20/2011). Between the right to personal identity and reserve of maternity

Abstract

The Act 19/2015 of July 13, on administrative reform measures in the area of the Administration of Justice and the Civil Registry modified (article 2) the birth registration of Act 20/2011, of July 21, Civil Registry. The changes in addition to involving a new configuration of the birth registration which highlights the unavoidable constancy of motherhood affect the protection of the rights of the person, in particular of the newborn in the context of their identity, but also of the mother who is allowed to renounce the exercise of filiation rights. This paper deals the formation of the norm and the main consequences.
