¿Puede el empresario modificar el derecho a la reducción de jornada por cuidado de un menor a través de la modificación sustancial de las condiciones de trabajo?

Abstract

The reduction of working hours for taking care of children presents many problems in its practical implementation. One of them is the interaction with other internal flexibility legal mechanisms, such as the substantial modification of working onditions. This case commentary deals with the compatibilityproblems between articles 37.6 and 41 TRLET, especially after an initial request for reduction of working hours which is subsequently modified, in the light of Judgment no. 273/2018 of the Social Court no. 4 of Murcia. Specifically, the underlying debate under examination is the conflict between the exercise of the right to the reduction of working hours for childcare and the substantial modification of working conditions, and with regard to this, two issues present in the judgment under comment will be examined: the possibility of requesting, on the part of the employer, a modification of the educed working hours for childcare ex article 41 TRLET, and the scope of the causality of article 41 TRLET in this situations.
