¿Nuevas perspectivas para el delito ecológico en España? A propósito de la nueva Directiva relativa a la protección del medio ambiente mediante el Derecho penal y por la que se sustituye la Directiva 2008/99/CE

Following the simile of a disease, we start from the problems of application of environmental criminal law in Spain and the diagnosis carried out by the instruments of the European Union to focus on analyzing whether the treatment proposed by the new Directive on the protection of the environment through criminal law can remedy the problem. The research concludes that the key to the most effective application of ecological crime in Europe will not come from the proposals for harmonization of infractions and sanctions (Law), but from the rest of the proposals that the Directive makes at the criminal policy level (Policy). Fundamentally, a comprehensive reform of environmental law that - aligned with a concept of sustainable economic growth - lowers the levels of legal, administrative and judicial tolerance towards polluting activities.
