Abstract
The aim of the Labour Law from 9 March 1938, in its second Declaration (in fine), was to free married women from the factory. The legal order from the first years of the Franco regime had a direct impact on the labour opportunities of working women who had lost the advantages acquired during the Second Republic.
Married women had to work in the first place at home and had to keep away from other jobs. One of the concerns of the regime was that the salary received by the husband had to be enough to afford a comfortable life so that the economic participation of the wife was not necessary.
The protection offered to women by the Placement Services was subject to some strict conditions. Women who during the war – defending the Franco rebellion- had lost relatives from whom the family economy was dependent were given a more favourable treatment.
Labour Regulations established the general principles to regulate the labour conditions and implemented a salary discrimination between men and women. Women would receive a lower salary and in the majority of texts the compulsory leave for marriage was noted.
