Abstract
This article aims to analyze the changes introduced by Law 3/2014 referring to the pre-contractual information duties in B2C contracts. This law reflects the need to transpose Directive 2011/83/EU that under the principle of maximum harmonization to standardize the laws of consumer law of the Member States of the EU. The EU, in accordance with the powers conferred by Articles 114 and 169 TFEU, has increased the protection of consumers in respect of pre-contractual information duties, since the transposition of Directives 85/557/EEC and 97/7/EC on contracts negotiated away from business locations and distance contracts respectively, resulted in a disparity of legislation in EU-Member States which undermined the confidence of consumers and businesses in cross-border operations.
