Abstract
Law 16/2022 introduces the new article 435.3 of the Consolidated Text of the Insolvency Law admits, by which under certain conditions a conventional agreement to give reciprocal preference or postponement between creditors shall be recognized and executed within the common debtor's bankruptcy. This is an exception to the mandatory regime of payment of credits according to the classification of insolvency claims.
