Abstract

In recent years, within the ever-changing world of productive decentralisation, two ways have emerged whose objective is to facilitate that a foreign company that has no headquarters subsidiary or branch in Spain can have the necessary personnel to be able to develop its business activity in Spanish territory. These two methods are the use of a temporary employment agency (ETT –abbreviation of de Spanish term–) established in Spain and contracting with an employer of record (EOR) company. This paper analyses both formulas and their legal viability in Spain, taking into account the provisions of article 43 of the Workers' Statute regarding the illegal transfer of workers.
