The purpose of this paper is to analyze the STC 95/2017, dated July 6th, which declares the temporal ownership of the Civil Code of Catalonia to be constitutional. This sentence determines the nature of temporalownership as an institution of divided ownership and establishes that between the emphyteusis and the regulation of temporary property there is a mediated connection that allows to affirm that the Catalan lawmaker did not overstep in the exercise of his powers in subject of development of the Catalan civil law.
