Abstract

Royal Decree 173/2023, of 14 March, was published in the Official Spanish Gazette on 14 March 2023 to regulate the military training and career of Her Royal Highness the Princess of Asturias, Leonor de Borbón y Ortiz. This regulation envisages military training lasting three years which will take place in the three Spanish armed forces and that the heir to the throne will end up being an officer of the Army, of the Air Force and of the Navy. The military training and career of her father, King Philip VI, was also established by royal decree. This text raises the question of whether this legal instrument is the most suitable to regulate this aspect of the Crown or whether, on the contrary, another type of legal tool would be more appropriate. It is concluded that the royal decree is not the ideal instrument to regulate these matters and that it would be more convenient to use an organic law within the framework of a general regulation of the Crown.
