El derecho de las víctimas colectivas a participar en encuentros restaurativos: Un análisis a partir de algunos delitos económicos

This article aims to explore the viability of implementing restorative justice encounters in the field of white-collar crimes. In order to do so, two main issues are addressed. Firstly, the article analyses who should be considered a legitimate representative of a supra-individual group of victims and what criteria would guarantee that such representatives will indeed defend these general or collective interests. Secondly, it examines how to identify and quantify the harm perpetrated on supra-individual groups of victims, in particular in regard to the economic aspects of white-collar crime. This problem has not been adequately addressed by the current criminal justice system so far. Thus, it is essential to analyze how to evaluate material and immaterial harm and to determine what the most appropriate way would be to compensate the victims of these crimes either during or after the trial process.
