Abstract
Certain online communities attack women individually, in groups or people based on their gender, sexual orientation or gender identity through clearly misogynistic content. These actions represent a conflict between the right to freedom of expression and other fundamental rights, including the right to equality. The Law has traditionally be applied to solve potential conflicts between freedom of expression and other human rights, but not generally to the principle of equality. Furthermore, they occur in a virtual context that goes beyond traditional legal frameworks limited to national territories. The criminal response is insufficient, since it punishes only the most serious behaviours that constitute hate speech. As an alternative, it would be necessary to apply and develop anti-discrimination law to protect the right to equality and provide reparation to victims.
