Abstract

The maritime passenger transport contract is stipulated especially on cruise ships, ferries and vessels dedicated to coastal tourism. During the maritime phase, the embarkation or disembarkation or the transfer of the ship to the port or vice versa, the passenger may suffer an accident, resulting in injuries and even death. The most common individual accidents are falls on deck, in the cabin, or into the sea, but others such as food indigestion, assaults between passengers and/or sailors and many other possible ones are also recorded. Individual accidents do not usually affect navigation and, if the carrier is responsible, the compensation is small. Naturally different are navigation accidents, such as a grounding, a collision, a fire on board or even the sinking of a passenger ship. In these cases of collective accidents or large accidents, the compensation is usually higher, since the personal damages are more important and have to be multiplied by all the passengers affected.
