Abstract

In the ruling commented upon, the Court of Justice of the European Union decides on the limits of the freedom of choice in the field of the law applicable to consumer contracts. There are two important points to take into consideration: the formal obligation that imposes to incorporate in the clause of submission the mandatory rules provided by the law of the residence of the consumer in order to guarantee his/her protection; and the restrictive interpretation of article 6.4.a of Rome I Regulation in order to determine the concept of the place where services are to be supplied to the consumer exclusively in a country other than in which he has his habitual residence
