Resum
Since the mid-nineties of the last century, a body of case law has been forging in the courts that endorsed the disconnection between land valuation and classification in the case of land destined for general systems that were classified as undevelopable or lacked specific classification. Surpassing the legal postulate that «Land will be valued according to its class and situation» (art. 25 LS of 1998), such land was valued as developable, provided that the infrastructure justifying its expropriation was intended to «create a city». After the failed attempt of the legislator to finalize this doctrine in 2002, it has been Law 8/2007 on Land and subsequent legislation which, by omitting any reference to the urban classification and attending exclusively to the factual or real situation of the land, make inapplicable the doctrine of general systems that create the city.
