N2 - The Convention of Persons with Disabilities was a historic milestone, which meant the integration of the social model of disability into the legal framework. Although Law 26/2011 was in charge of adapting certain aspects of the Spanish legal framework, the progressive European expansion of the term “disability” highlights the insufficient adaptation of the Spanish legal system to the requirements of the CRPD, especially in relation to the extinction resulting from the supervening ineptitude of the worker known or occurring after his or her actual placement in the company (art. 52.a of the TRLET).Faced with this scenario, the aim of this article is to examine the aspects of the extinction due to supervening ineptitude that are most disconnected from the CRPD, offering proposals for improvement that guarantee an open and inclusive labour market that does not expose people with disabilities to an additional risk of terminating their employment contracts
